1. Acceptance of Terms

By accessing and using PokerGenius ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the below, please do not use this service.

2. Description of Service

PokerGenius provides poker analysis tools including Monte Carlo simulations, hand evaluation, odds calculation, and AI-powered recommendations for Texas Hold'em poker. Our service is designed for educational and analytical purposes.

3. User Obligations and Restrictions

• You must be at least 18 years old to use this service
• You are responsible for maintaining the confidentiality of your account credentials
• You may not use our service for any illegal or unauthorized purpose
• You may not attempt to gain unauthorized access to any portion of the service
• You may not use automated systems or software to extract data from our service
• You may not reverse engineer, decompile, or disassemble any portion of the service
• You may not create multiple accounts to circumvent usage limitations
• You may not share your account credentials with others
• Check local regulations before using analytical tools during live poker play

4. Subscription and Payment Terms

• Billing: Subscription fees are billed in advance on a monthly or annual basis
• Auto-Renewal: Subscriptions automatically renew unless cancelled before the renewal date
• Cancellation: You may cancel your subscription at any time; service continues until the end of the current billing period
• Refunds: Refunds are provided at our discretion and generally limited to the current billing period
• Price Changes: We may change subscription prices with 30 days advance notice
• Payment Processing: Payments are processed by Stripe, subject to their terms of service

5. Intellectual Property Rights

All content, features, and functionality of PokerGenius, including but not limited to algorithms, software, text, displays, images, video, and audio, are owned by PokerGenius and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

6. User-Generated Content

You retain ownership of any content you submit to PokerGenius. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, modify, and display such content solely for the purpose of providing our services.

7. Service Availability and Maintenance

• Uptime: We strive for 99.9% uptime but do not guarantee uninterrupted service
• Maintenance: We may perform scheduled maintenance with advance notice when possible
• Force Majeure: We are not liable for service interruptions due to circumstances beyond our control

8. Disclaimers and Limitations

• Educational Purpose: PokerGenius is intended for educational and analytical purposes only
• No Guarantee: We make no guarantees about the accuracy of calculations or recommendations
• No Liability: We are not liable for any losses incurred through use of our service
• Third-Party Services: We are not responsible for third-party services integrated into our platform
• Data Loss: We are not liable for any loss of user data, though we maintain regular backups

9. Limitation of Liability

IN NO EVENT SHALL POKERGENIUS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to defend, indemnify, and hold harmless PokerGenius from and against any claims, damages, costs, and expenses, including attorneys' fees, arising from or related to your use of the Service or violation of these Terms.

11. Termination

• By You: You may terminate your account at any time through your account settings
• By Us: We may terminate or suspend your account immediately for breach of these Terms
• Effect of Termination: Upon termination, your right to use the service ceases immediately
• Data Retention: We may retain certain data as required by law or legitimate business purposes

12. Governing Law and Dispute Resolution

These Terms shall be interpreted and governed by the laws of the State of Nevada, United States. Any disputes arising from these terms shall be resolved through binding arbitration in Nevada, with each party bearing their own legal costs.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and PokerGenius regarding the use of our service and supersede all prior agreements.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. Continued use of the service constitutes acceptance of revised terms.
